Two actions in the district court for Washington county, consolidated for trial and heard together on appeal, one on behalf of Jane Hagerty, a minor, by her father and natural guardian, to recover for the loss of two fingers on her right hand claimed to be the result of the negligence of defendants in the care of a stallion owned by them, and the other action by the father on his own behalf to recover for medical expenses incurred. The cases were tried before Alfred P. Stolberg, Judge, and a jury, which returned a verdict for defendant Henry J. Radle in the fathers action, and one of $10,000 for the minor against said defendant, the actions having been dismissed as to defendant Thomas H. Radle. From an order denying his alternative motion for judgment or a new trial in the minors action after a reduction of the verdict to $8,500 was accepted by plaintiff, defendant Henry J. Radle appealed.
